പാപ്പിനിശ്ശേരി പഞ്ചായത്തില്‍ വളപട്ടണം പാലത്തിനു സമീപം വര്‍ധിച്ചു വരുന്ന കണ്ടല്‍കാടു നികതലിന്നെതിരെ  പ്രതിഷേധ ജാഥയും പൊതുയോഗവും നടത്തി. മാര്ച് 7 നു വൈകുന്നേരം പഴയങ്ങാടി റോഡ്‌ കവലയില്‍ നിന്നും ആരംഭിച്ചു പാപിനിശ്ശേരി പഞ്ചായത്ത് ഓഫീസിനു മുന്‍വശത്ത് സമാപിച്ച ജാഥക്ക് സംസ്ഥാന കമ്മറ്റി അംഗം പി വി ദിവാകരന്‍,  ജില്ല സെക്രട്ടറി ടി വി നാരായണന്‍, പരിസര വിഷയ സമിതി കണ്‍വീനര്‍  കെ വി ജാനകി ടീച്ചര്‍, കെ ബാലകൃഷ്ണന്‍, എം സുജിത്, പി ധര്‍മന്‍ തുടങ്ങിയവര്‍ നേതൃത്വം നല്‍കി. പൊതുയോഗത്തില്‍ സംസ്ഥാന കമ്മറ്റി അംഗം പ്രൊഫ്‌. എന്‍ കെ ഗോവിന്ദന്‍, മേഖല പ്രസിടന്റ്റ് കെ വി ബാലകൃഷ്ണന്‍ , കെ വിനോദ് കുമാര്‍ എന്നിവര്‍ സംസാരിച്ചു. പഞ്ചായത്ത്‌ അധികാരികള്‍ക്ക് നിവേദനം നല്‍കി.

വളപട്ടണം പുഴയുടെ തീരത്ത് പാലത്തിനു സമീപം വ്യാപകമായി കണ്ടല്‍ക്കാട് നശിപ്പിക്കുകയും മണ്ണിട്ട്‌ നികത്തുകയും ചെയ്യുന്നതു പരിഷത്ത് പ്രവര്‍ത്തകര്‍ തടഞ്ഞു. ജില്ലാ സെക്രട്ടറി, പ്രസിഡന്റ്‌ എന്നിവരുടെ നേതൃത്വത്തില്‍ എ.ഡി.എം, ഫോറെസ്റ്റ് ഓഫീസിര്മാര്‍ എന്നിവരെ ബന്ധപ്പെടുകയും നികത്തുന്ന  സ്ഥലത്തെത്തി ജെ സി ബി യെ തടയുകയും ചെയ്തു. നടപടികള്‍ സ്വീകരിക്കണം എന്നാവശ്യപ്പെട്ടു  അധികാരികള്‍ക്ക് പരാതി നല്‍കി.

                        Subject:  Land filling of wet land on the banks of Valapattanam river near
                                        Valapattanam bridge in Pappinissery  Panchayath

This is to bring to your urgent  notice, the unlawful reclamation of mangrove  wet land on the pappinissery side of valapattanam  river bank which comes under   CRZ-1 zone. The unlawful activity, which is the last one in a series of such acts  for the last 5 years,  came to the public notice on 5/2/2011 Saturday. The land coming under survey No.227/1 under the ownership of   Mr.Ramachandran , in Pappinisssery  Grama Panchayath,  near western side of  Valapattanam bridge, lies  on the banks of valapattanam river which comes under tidal influences.
 On Saturday 5/2/2011 after noon,  local people on seeing  trucks loads  of building waste materials being unloaded in this area  alerted us. We visited the place and found that  construction waste materials  were  dumped in heaps, obviously intended for levelling the plot land. There were large destruction of mangroves. We informed the media and the same had been carried by Sunday’s news papers. Irrespective of the   publicity and utter disregard for the public out cry against the un- lawful activities, on Monday 7-2-2011 a JCB was found to be operating in the area. We informed ADM and pleaded for an immediate action so that the work going on at the site is stopped at once and the culprits are brought to books.  In the mean time  our activists who reached the spot found the JCB still working and as informed by them more of us reached the place and requested the JCB driver to stop the work. We pointed out to him that the leveling of the wet land in that part of the Valapattanam banks amounts to violation of CRZ-1  regulations and can invite penal punishment.  Two other by standers present at the site, though disowned any responsibility to the activities carried out over there, obviously were supervisors of the work being carried out. By the time police force from the Valapattanam Police station as directed by the ADM arrived on the spot, the driver and the two by standers made good their escape.  After a while Forest guards from Kannur also arrived. We explained to the authorities the sequence of events happened that day and requested to register cases against the culprits under the CRZ act and Wet land and paddy field conservation acts. The police were not able to seize the JCB as the driver was not available and documents of the vehicle was missing. However they have noted down the registration number of the vehicle and assured us of stringent action against the people behind this illegal activities.

 In light of the above described circumstances we wish to invite your attention to the fact that this kind of violation of the CRZ act is quite rampant in many part of our district, and at this particular area it was happening for the last ten years with varying intensity. Every time when it had come to our notice we as an organization concerned about the dismal state of our wet land and mangrove eco system conservation, had approached the concerned forest and district authorities for a permanent stoppage of such activities and insisted on to initiate legal action against such vandal disregard for the rule of the land. In fact we had submitted many memorandums to your good self in different occasions in the past, each time being provoked by such repeated attacks on the flora and fauna of that area, we had pleaded for strict action and a permanent solution for the conservation of the fragile ecosystem that the mangrove wet lands abounds.  On 29-4-2008 we had submitted one such memorandum to the District Collector when we found that truck loads full  of dumping material being carted to the above cited  area. This memorandum is recorded under 2008/20075/13-L3 dated 26-5-2008 RDO Thalassery. Then we had approached the Pappinissery Grama Panchyath with our memorandum dated 7/3/09 on a similar instance. A fresh memorandum dated 19-6-2010 was submitted to District Collector with copy to Panchayath authorities when such violation repeated. Another Memmorandum dated 17/6/2010 was submitted to the District Collector, Kannur  pleading for sterner steps when the miscreants repeated their illegal activities. Despite all our above mentioned efforts, it is highly unfortunate that no concrete and fruitful measures were taken by the concerned authorities for the protection and conservation of the mangrove wet lands of this area.

We would like to draw your attention to a similar very popular just concluded instance happened on the other side of the Valapattanam bridge. Here when the Kerala State Coastal Zone Management  Authoririty  was convinced that the so called Pappinissery Eco Tourism society had violated the CRZ norms and the relevant clauses of the Kerala State Conservation of the paddy fields and wet land Act 2008, in a much laudable decision had directed the district revenue authorities to dismantle all the constructions in the park and notably, initiated action to reinstate the morphology of the said area. It may kindly be noted that the present area under question had a similar lush growth of mangroves until recently and lies at same distance as the “ Kandal Theme park “ area from the High Tide Level of the Valapattanam river.  There cannot be double standards in interpreting the rules and regulation when it is applied to the two above mentioned sites. Hence we are much obliged to request that the conservation deficiencies of the present area in question may kindly be brought to the notice of the Kerala State Coastal Zone Management  Authority and a decision in tune with the ruling on the issue of Kandal Theme park may kindly be brought about.

In the context of all the issues discussed above we put forward the following demands for the immediate implementation with high regards for the conservation of the remaining wet lands on the banks of Valapattanam river:

1.      A thorough enquiry may be ordered to find out the culprits who  had caused the wider destruction of the mangrove vegetation in the areas on the western side of the Valapattanam bridge on the Pappinissery side of the river bank, and stringent action may be initiated against them.

2.      Penal actions may be initiated against the owner of the land under the survey number 227/1 or who ever has indulged in the act of unlawful reclamation of the mangrove wet land using JCB on 7-2-2011 as pointed out in the second para of this memorandum, under the relevant clauses  of CRZ-1 regulations and Kerala State Conservation of the paddy fields and wet land Act 2008. The said area may be brought back to the original conditions by removing all the construction materials brought from outside and the morphology of the area be reinstated. The cost of this may be levied from the accused.

3.       A long term plan for conservation and protection of the Mangrove wetlands on the entire river banks of Valapattanam River may be brought about after declaring the entire area as Forest Reserve.
